Terms and Conditions

1. Agreement

These Terms and Conditions form a binding agreement between you (or the organisation you represent, the "Customer") and Techly Marketing Limited, a company registered in Nigeria ("Attrevo", "we", "us").

By creating an account, accepting these terms during onboarding, or using the service, you confirm that you have authority to bind your organisation and that you accept these terms.

2. The service

Attrevo is a marketing attribution platform. Subject to your plan, it provides:

• Multi-touch attribution across five attribution models.
• Revenue attribution from connected Nigerian payment platforms.
• Lead matching, including matching by phone number.
• Campaign conversion diagnostics and dashboards.
• An AI assistant for attribution insights.
• NDPR-oriented consent management for the tracking snippet.
• Scheduled WhatsApp reporting where enabled.

We may add, change, or remove features. Where a change materially reduces functionality on your current plan, we will give at least 30 days' notice.

3. Accounts

• You are responsible for the accuracy of the information you provide and for keeping it current.
• You are responsible for all activity under your account and for safeguarding access credentials and API keys.
• You must notify us promptly of any suspected unauthorised access.

4. Acceptable use

You must not:

• Use Attrevo to collect personal data without a lawful basis, or in breach of the NDPR or any other applicable law.
• Install the tracking snippet on any website you do not own or control, or without displaying the required consent notice.
• Upload or process special categories of personal data — including health, biometric, genetic, or financial account credentials — through the platform.
• Attempt to gain unauthorised access to the platform, other tenants' data, or the underlying infrastructure.
• Reverse engineer, resell, sublicense, or white-label the service without our written agreement.
• Use the service to send unsolicited bulk messages, or in any way that places disproportionate load on the platform.

We may suspend an account that breaches this section, with notice where practicable and immediately where required to protect the platform or other customers.

5. Subscriptions, fees, and VAT

Attrevo is sold on a monthly subscription. Published prices are in Nigerian Naira (₦) and are inclusive of 7.5% Value Added Tax as required by the Value Added Tax Act.

• Fees are billed in advance each month and renew automatically until cancelled.
• A tax invoice showing the VAT component is issued for every successful payment.
• You may cancel at any time; cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law.
• If a payment fails, we may retry it and may suspend access if the balance remains unpaid after 14 days.
• We may change prices with at least 30 days' notice. Continued use after the change takes effect constitutes acceptance.

6. Data processing

Where you use Attrevo to process personal data about your own visitors, leads, and customers, you act as the data controller and we act as your data processor. In that capacity we will:

• Process personal data only on your documented instructions.
• Apply appropriate technical and organisational security measures.
• Impose equivalent obligations on any sub-processor we engage.
• Assist you in responding to data subject requests and in meeting your breach notification duties.
• Delete or return personal data on termination, subject to legal retention requirements.

7. Intellectual property

The Attrevo platform, its software, design, and branding remain the property of Techly Marketing Limited. You retain all rights in the data you submit. You grant us a limited licence to process that data solely to provide the service.

8. Availability

We aim for high availability but do not guarantee uninterrupted service on standard plans. Planned maintenance will be notified in advance where practicable. Specific availability commitments are available on Enterprise plans by separate agreement.

9. Limitation of liability

To the fullest extent permitted by Nigerian law:

• The service is provided on an "as is" basis. Attribution outputs are analytical estimates and should not be treated as audited financial statements.
• We are not liable for indirect, incidental, special, or consequential loss, or for loss of profits, revenue, goodwill, or data.
• Our total aggregate liability arising out of or in connection with these terms is limited to the fees you paid in the three months preceding the event giving rise to the claim.
• Nothing in these terms excludes liability that cannot lawfully be excluded, including for fraud or death or personal injury caused by negligence.

10. Indemnity

You agree to indemnify us against claims arising from your unlawful use of the service, your breach of these terms, or your failure to obtain a lawful basis for the personal data you process through Attrevo.

11. Termination

You may close your account at any time. We may terminate or suspend this agreement on notice for material breach, non-payment, or where required by law. On termination your access ends and your data is deleted in line with the retention periods in our Privacy Policy.

12. Governing law and disputes

These terms are governed by the laws of the Federal Republic of Nigeria.

The parties will first attempt to resolve any dispute in good faith within 30 days of written notice. Failing that, the dispute is subject to the exclusive jurisdiction of the courts of Lagos State, Nigeria.
